Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your access to and use of the Kash website at kash.cards, the Kash app, the Kash virtual card, and related services (together, the "Service"), operated by Kash ("Kash", "we", "us"). By creating an account, topping up, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Kash works with regulated partners to deliver the Service. The Kash virtual card is issued by a licensed card issuer under the relevant card-scheme rules, and certain services are provided subject to those partners' terms, which you also agree to where they apply.

Kash provides a virtual payment card that you fund by topping up with USDT (a stablecoin). When you make a purchase, the required amount is converted from your balance to fiat currency and settled with the merchant. The card can be added to supported mobile wallets and used wherever the card scheme is accepted, subject to merchant acceptance and applicable limits.

4. Your account & verification

To use the Service you must create an account and complete identity verification. We (and our partners) are required to collect and verify identity information to meet anti-money-laundering and counter-terrorism-financing (AML/CTF) obligations. We may refuse, limit, suspend, or close accounts where verification cannot be completed or where required by law. You are responsible for keeping your account details and credentials secure and up to date.

5. Topping up with USDT

You fund your Kash balance by sending USDT to the address or method we provide. Only send the supported asset (USDT) on a supported network; assets sent on unsupported networks or in unsupported tokens may be lost and may not be recoverable. Top-ups are credited after the required network confirmations. We may set minimum and maximum top-up amounts and may apply holds for risk or compliance checks.

6. Fees

Kash charges a flat 3% fee on each top-up, deducted upfront at the time you top up. This means the balance credited to your card is the amount you topped up less the 3% fee, and that credited balance is the amount available to spend. We do not charge a monthly account fee and we do not add a hidden foreign-exchange markup on the conversion described in section 8. Third parties (for example, networks, merchants, or ATM operators) may charge their own fees outside our control. We will tell you about any changes to our fees in advance as required.

7. Using your card

You can use your Kash virtual card to pay online and in-store (via supported mobile wallets) wherever the card scheme is accepted. Transactions are subject to your available balance, card-scheme rules, merchant acceptance, and any limits or controls we apply. You can freeze or cancel your card from the app. Some merchant types (for example, certain high-risk categories) may be blocked.

8. Conversion & exchange rates

When you transact, we convert the amount needed from your USDT-funded balance to the settlement currency at the rate applying at the time the transaction is processed. Rates move with the market; the rate shown at checkout or in the app is indicative until the transaction settles. You accept the rate applied at processing time.

9. Acceptable use

You must not use the Service to: break any law or regulation; launder money or finance terrorism; commit fraud; evade sanctions; purchase prohibited goods or services; infringe others' rights; or attempt to interfere with, reverse engineer, or gain unauthorised access to the Service. We may report unlawful activity to the relevant authorities.

10. Security & your responsibilities

Keep your login credentials, device, and card details confidential. Tell us immediately if you suspect unauthorised access or a lost/compromised device. You are responsible for activity on your account except to the extent caused by our failure or covered by applicable consumer protections and the card scheme's rules.

11. Risks

Kash is not a bank and balances are not deposits. Nothing here is financial product advice.

12. Suspension & closure

We may suspend or close your account or the Service (in whole or part) where required by law or our partners, to manage risk or fraud, or if you breach these Terms. Where we close your account, we will return any remaining available balance to you using a lawful method, less any amounts we are entitled to retain.

13. Liability

To the maximum extent permitted by law, Kash is not liable for indirect or consequential loss, or for loss arising from matters outside our reasonable control (including network, merchant, or third-party failures). Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded; where liability cannot be excluded, it is limited to the extent permitted by law.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "last updated" date and, where the change is material, give you reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Australia and the state or territory in which Kash is established, and you submit to the non-exclusive jurisdiction of its courts.
